What is the law regarding smoking in public places?

The Tobacco Reduction Act regulates smoking, prohibiting it in public places and workplaces since January 1, 2008. For detailed information, refer to the original legislation available at the City Clerk's office.

As of January 1, 2008, the Provincial Tobacco Reduction Act became law. The act prohibits smoking in public places and workplaces.

The regulation further:

  • Increases the distance for smoking prohibition from doorways, windows, or air intakes to 5 meters (previously 3 meters under the Smoking and Vaping Bylaw).
  • Sets guidelines for displaying signs listing tobacco products and prices.
  • Empowers inspectors to carry out their duties as needed and outlines their responsibilities.
  • Grants exemptions to specific retailers, like tobacconists, from certain provisions of the Act regarding display and promotion.
  • Specifies the criteria retailers must meet to qualify for exemptions.

Is there a bylaw regulating electronic cigarettes (e-cigarettes)?

Yes, there is a bylaw regulating electronic cigarettes (e-cigarettes). It prohibits the use of e-cigarettes in public places where tobacco smoking is already prohibited. However, there is an exception for the sampling of e-cigarettes, which is permitted only in standalone, enclosed retail vape shops. This exception does not extend to smoking e-cigarettes at kiosks in malls or any other establishments such as restaurants or bars.
